QQuestions:
Will Principles concerning the protection of personal data in the workplaces: guidelines for employee monitoring pose a hurdle to an employer's effective management?
AReply

The PDPB desires that employers as well as employees come to understand that conducts such as employers keeping surveillance on employees are matters that must be kept in compliance with the Personal Data Protection Act and the Principles concerning the protection of personal data in the workplaces: guidelines for employee monitoring. While taking the decision to keep surveillance on employees, an employer should make detailed, all-round consideration with a view to ensuring the protection of personal data. If such a decision is taken, the enterprise may use the sample personal data collection that comes with the Guidelines as a basis to build its own personal data collection statement, to avoid hampering the employees' right to information as well as prevent breach of law. Therefore, the Guidelines are conducive to taking decisions in line with the law. An articulate statement will not only expedite the establishment of mutual trust between the employer and the employees, but also make the entrepreneurial management effective.
